IN NO EVENT SHALL BRUSH BULLET'S TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY THE CUSTOMER TO BRUSH BULLET DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to defend, indemnify, and hold harmless Brush Bullet and its owners, officers, directors, employees, contractors, affiliates, dealers, agents, successors, and assigns from any claims, liabilities, damages, losses, costs, or expenses arising from:

• Your infringement of third-party rights.

Brush Bullet shall not be liable for delays or failures resulting from circumstances beyond its reasonable control, including:

Arbitration shall be administered by the American Arbitration Association (AAA) under its applicable rules. The arbitration shall occur in the State of Texas.
