Warranty, Returns & Refund Policy

This Warranty, Returns & Refund Policy ("Policy") governs all purchases of Brush Bullet products and is incorporated into the Brush Bullet Terms of Service and Product Use, Safety, Regulatory Compliance & Liability Terms.
By purchasing, possessing, handling, transporting, storing, applying, recommending, or using Brush Bullet products, you agree to this Policy.
1. All Sales Subject to Product Use Terms
All Brush Bullet products must be used in accordance with:
- Product labels
- Safety instructions
- Applicable federal laws
- Applicable state laws
- Regulatory requirements
- Product Use, Safety, Regulatory Compliance & Liability Terms
Failure to follow applicable requirements may void eligibility for refunds, credits, replacements, or warranty consideration.
2. Limited Product Warranty
Brush Bullet warrants only that products sold by Brush Bullet:
- Conform to the product description appearing on the product label at the time of sale; and
- Are packaged in accordance with applicable quality control standards.
Except as expressly stated herein, no additional warranties are provided.
3. No Performance Warranty
Brush Bullet does not warrant or guarantee:
- Complete brush eradication
- Specific kill rates
- Acreage results
- Economic outcomes
- Operational outcomes
- Land improvement outcomes
- Revenue increases
- Ranch productivity improvements
- Agricultural productivity improvements
- Specific vegetation control results
Actual results depend on numerous factors beyond Brush Bullet's control, including:
- Weather
- Rainfall
- Drought
- Soil conditions
- Target species
- Application timing
- Application methods
- Application rates
- Environmental conditions
- User skill and experience
Product performance may vary significantly.
4. Disclaimer of Implied Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRUSH BULLET DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- PERFORMANCE WARRANTIES
- RESULT WARRANTIES
No dealer, contractor, applicator, employee, representative, marketing material, website content, video, or communication may modify this disclaimer except through a written agreement signed by an authorized officer of Brush Bullet.
5. Return Eligibility
Brush Bullet may accept returns of unopened, unused products in original packaging subject to the following conditions:
- Return request submitted within thirty (30) days of delivery;
- Product remains unopened;
- Product remains unused;
- Product remains in original packaging;
- Product remains in resalable condition;
- Customer obtains prior return authorization.
Unauthorized returns may be refused.
6. Non-Returnable Products
The following are not eligible for return:
- Opened products;
- Used products;
- Partially used products;
- Damaged products;
- Contaminated products;
- Products stored improperly;
- Products altered after purchase;
- Clearance items;
- Final sale items;
- Promotional items;
- Products prohibited from return by law or regulation.
7. Refund Requests Based on Performance
Because product performance depends upon numerous factors outside Brush Bullet's control, dissatisfaction with treatment results alone does not automatically qualify a product for refund. Brush Bullet reserves sole discretion in evaluating product performance complaints. Brush Bullet may request:
- Purchase documentation;
- Application records;
- Photographs;
- Site information;
- Environmental conditions;
- Treatment details;
- Applicator information;
- Additional supporting documentation.
Failure to provide requested information may result in denial of the claim.
8. Damaged or Defective Products
Customers must inspect products promptly upon delivery. Claims involving damaged, defective, missing, or incorrect products must be submitted within ten (10) days of delivery. Brush Bullet may request:
- Photographs;
- Packaging information;
- Batch information;
- Shipping information;
- Return of the product.
Brush Bullet reserves the right to determine whether replacement, refund, credit, or other resolution is appropriate.
9. Shipping Costs
Original shipping charges are non-refundable except where required by law. Return shipping costs are the responsibility of the customer unless Brush Bullet determines otherwise in writing.
10. Return Authorization Required
Prior authorization must be obtained before returning products. Brush Bullet reserves the right to reject returns received without authorization. Return instructions may be obtained by contacting info@brushbullet.com.
11. Refund Processing
Approved refunds will generally be issued to the original payment method. Processing times may vary depending upon:
- Financial institutions;
- Payment processors;
- Banking systems;
- Regulatory requirements.
12. Limitation of Remedies
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CUSTOMER'S EXCLUSIVE REMEDY SHALL BE LIMITED TO ONE OF THE FOLLOWING, AT BRUSH BULLET'S SOLE DISCRETION:
- Replacement product;
- Store credit;
- Refund of the purchase price paid for the specific product involved.
No other remedy shall be available.
13. Exclusion of Certain Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRUSH BULLET SHALL NOT BE LIABLE FOR:
- Property damage;
- Crop damage;
- Livestock losses;
- Wildlife losses;
- Environmental damages;
- Lost profits;
- Lost revenue;
- Lost opportunities;
- Operational losses;
- Consequential damages;
- Special damages;
- Incidental damages;
- Punitive damages.
14. Maximum Liability
BRUSH BULLET'S MAXIMUM LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
15. Governing Law
This Policy shall be governed by the laws of the State of Texas.
